Borrower Defense: How to Respond to Borrower Defense Claims, Preserve all Applicable Defenses for any Hearing or Litigation, and Engage in Effective Government Relations Strategies
CECU offers a unique opportunity to learn about the U.S. Department of Education’s Borrower Defense Unit, which is actively engaged in investigating over 337,000 borrower defense to repayment claims against at least 266 institutions of higher education. The former U.S. Department of Education’s Deputy General Counsel for Postsecondary Education and current Partner at McGuireWoods LLP, Farnaz Thompson, will present an overview of the three sets of regulations governing borrower defense claims and will share specific strategies to respond to such claims. John Moran, the former Deputy Chief of Staff to the Attorney General and current Partner at McGuireWoods LLP, will discuss how to preserve all applicable defenses for any hearing or litigation under the Administrative Procedure Act and also will discuss the Department of Justice’s Guidance on False Claims Act matters. Laura Fornash, the former Secretary of Education of the Commonwealth of Virginia and Senior Vice President for Government Relations at McGuireWoods Consulting, will discuss effective government relations strategies for proprietary institutions. CECU’s Vice President for Government Relations will moderate a discussion on a comprehensive strategy to address borrower defense claims.
