Borrower Defense Litigation Update
Presenter: Nicholas Kent, Chief Policy Officer, CECU
On August 7, 2023, the U.S. Court of Appeals for the Fifth Circuit issued an order postponing the July 1, 2023, effective date of the Biden administration’s borrower defense to repayment and closed school loan discharge regulations. Unlike the appeals court’s previous stay, which applied only to educational institutions that are members of Career Colleges & Schools of Texas, the latest decision broadens the injunction to apply to all higher education institutions. Join CECU’s Chief Policy Officer Nicholas Kent as he walks through the Fifth Circuit's latest decision, its impact on postsecondary institutions, and next steps. The presenter will also discuss any U.S. Department of Education guidance recognizing the new nationwide injunction. Please note that this update will not be recorded, making it crucial to attend live to receive the latest information and insights.
