Washington D.C., October 02, 2014 -- Following the United States District Court for the District of Columbia's opinion on APSCU v. Duncan, Civil Action No. 14-277, Sally Stroup, executive vice president of government relations and general counsel at APSCU, issued the following statement: "We are pleased that the Judge agreed with us in deciding that the U.S. Department of Education failed to adequately explain its elimination of the safe harbor for graduation-based compensation and also failed to address concerns about the effects of the compensation regulations on diversity initiatives.
"In 2012, APSCU encouraged the Department to engage in additional rulemaking on these issues, but instead, the Department simply amended the preamble to the regulations in a way that failed to comply with the D.C. Circuit opinion. The Department should correct its errors by suspending the flawed regulations and engaging in a new rulemaking." Comments are closed.
