Secretary DeVos Delivers $6 Billion in Additional Grant Funding to Support Continued Education at America's Colleges, Universities
U.S. Secretary of Education Betsy DeVos announced in a press release on April 21, 2020 that after quickly making available more than $6 billion for colleges and universities to provide direct emergency cash grants to students, an additional $6.2 billion is now available to higher education institutions to ensure learning continues. The Department developed a webpage dedicated to how institutions can access these critical institutional funds.

The April 21, 2020 call focused on the Department providing new clarifying guidance regarding the use of the emergency financial aid grants to students as well as announcing that the Department is making immediately available to postsecondary institutions the remaining $6.2 billion for the institutional share of funds made available under the Higher Education Emergency Relief Fund.

Secretary DeVos Rapidly Delivers More Than $6 Billion in Emergency Cash Grants for College Students Impacted by Coronavirus Outbreak
U.S. Secretary of Education Betsy DeVos announced in a press release on April 9, 2020 more than $6 billion will be distributed immediately to colleges and universities to provide direct emergency cash grants to college students whose lives and educations have been disrupted by the coronavirus outbreak. The funding is available through the Higher Education Emergency Relief Fund authorized by the Coronavirus Aid, Relief, and Economic Security (CARES) Act, signed into law by President Donald J. Trump less than two weeks ago. The Department developed a webpage dedicated to how institutions can access these critical student funds.

Secretary DeVos Directs FSA to Stop Wage Garnishment, Collections Actions for Student Loan Borrowers, Will Refund More Than $1.8 Billion to Students, Families
In a March 25, 2020 press release, Secretary DeVos announced that, due to the COVID-19 national emergency, the Department will halt collection actions and wage garnishments to provide additional assistance to borrowers. This flexibility will last for a period of at least 60 days from March 13, 2020.

Secretary DeVos Suspends Federal Student Loan Payments, Waives Interest During National Emergency
In a March 20, 2020 press release, Secretary DeVos announced all borrowers with federally held student loans will automatically have their interest rates set to 0% for a period of at least 60 days. In addition, each of these borrowers will have the option to suspend their payments for at least two months to allow them greater flexibility during the national emergency.

*NEW* Application for New Awards Deadline Date; Higher Education Emergency Relief Fund (HEERF)
Published on June 24, 2020, this notice from the Office of Postsecondary Education establishes the deadline date for institutions of higher education that did not initially apply to receive allocations to transmit their applications for funds from the Higher Education Emergency Relief Fund under sections 18004(a)(1), 18004(a)(2), and 18004(a)(3) of the CARES Act as August 1, 2020. 
 
*NEW* Higher Education Emergency Relief Funding Technical Assistance Webinar
On June 23, 2020, the Office of Postsecondary Education hosted a webinar that provided technical assistance to institutions of higher education in response to the Coronavirus Aid, Relief, and Economic Security Act, including the Higher Education Emergency Relief Fund.
 
Eligibility of Students at Institutions of Higher Education for Funds Under the Coronavirus Aid, Relief, and Economic Security (CARES) Act
Published on June 17, 2020, the Office of Postsecondary Education released the official version of an interim final rule (“IFR”) that clarifies which students are eligible for emergency financial aid grants under the Higher Education Emergency Relief Fund (“HEERF”). Updated Guidance for interruptions of study related to Coronavirus (COVID-19)
Published on May 15, 2020 and last updated on June 16, 2020, this electronic announcement from the Office of Postsecondary Education provides institutions of higher education new and expanded Title IV flexibilities due to the Coronavirus emergency. This guidance supplements related guidance issued by the Department on March 5, 2020 and April 3, 2020 as well as implements several provisions of the Coronavirus Aid, Relief, and Economic Security Act, which was signed into law on March 27, 2020.

Higher Education Emergency Relief Fund Reporting – Emergency Financial Aid Grants to Students & CECU Reporting Template
Published on May 6, 2020, this electronic announcement from the Office of Postsecondary Education describes initial reporting requirements and submission deadlines for postsecondary institutions that receive an allocation under the Higher Education Emergency Relief Fund for emergency financial aid grants to students. CECU developed a user-friendly reporting template that institutions can use to report the items listed in the Department’s electronic announcement.

Updated Guidance for interruptions of study related to Coronavirus (COVID-19)

Published on April 3, 2020, this electronic announcement from the Office of Postsecondary Education provides updated information that expands upon the Department’s March 5, 2020 guidance and provides additional regulatory flexibilities due to the lawful declaration of the COVID-19 national emergency.

Guidance for interruptions of study related to Coronavirus (COVID-19)
First published on March 5, 2020 and updated on March 20, 2020, this electronic announcement from the Office of Postsecondary Education addresses concerns expressed by higher education leaders regarding how they should comply with Title IV, Higher Education Act policies for students whose activities are impacted by Coronavirus (COVID-19), either directly because the student is ill or quarantined, or indirectly because the student was recalled from travel-abroad experiences, can no longer participate in internships or clinical rotations, or attends a campus that temporarily suspended operations. This information provides flexibilities for schools that are working to help students complete the term in which they are currently enrolled.

Published on March 17, 2020, the Office of Postsecondary Education announced temporary flexibilities to accrediting agencies to help them serve institutions and students through the period of COVID-19 interruption.

Office for Civil Rights

Questions and Answers for Postsecondary Institutions on Issues Related to COVID-19
On May 12, 2020, in response to inquiries received by the Department, the Office for Civil Rights issued a technical assistance document to assist postsecondary institutions with meeting their obligations under Federal civil rights laws during this difficult and unprecedented time. OCR will continue to update this document as needed throughout the crisis.

Webinar, Fact Sheet for Protecting Students’ Civil Rights During COVID-19 Response
On March 17, 2020, the Office for Civil Rights released a webinar on ensuring web accessibility for students with disabilities for schools utilizing online learning during the Coronavirus (COVID-19) outbreak. In addition, OCR published a fact sheet for education leaders on how to protect students' civil rights as school leaders take steps to keep students safe and secure. 

OCR Coronavirus Statement
On March 4, 2020, Assistant Secretary for Civil Rights Kenneth Marcus issued a statement to education leaders regarding reported cases of coronavirus bulling based on race and national origin.

Coronavirus Relief Oversight Plan
Made available on May 5, 2020, the Office of Inspector General identifies potential subject areas that may be included in its CARES Act oversight work, including a focus on schools’ use of the Higher Education Emergency Relief Fund.

Issuance of Dear CPA Letter CPA-20-01, Site Visit Exemption During COVID-19 Outbreak
Published on March 11, 2020, this electronic announcement from the Office of Inspector General describes a limited exemption from the site visit requirement during the outbreak of COVID-19 “Coronavirus” for audits conducted using the September 2016 Audit Guide. The exemption described in the letter applies to proprietary school audits of fiscal years ending between September 30, 2019 and December 31, 2019 that are conducted using the Audit Guide.

FAQs: Higher Education Emergency Relief Fund and Emergency Financial Aid Grants under the CARES Act
On May 7, 2020, the Internal Revenue Service released guidance on the taxability of the emergency financial aid grants under the Coronavirus Aid, Relief, and Economic Security Act (CARES) Act. In a FAQ, the IRS states that the “[e]mergency financial aid grants under the CARES Act for unexpected expenses, unmet financial need, or expenses related to the disruption of campus operations on account of the COVID-19 pandemic, such as unexpected expenses for food, housing, course materials, technology, health care, or childcare, are qualified disaster relief payments under section 139 of the Internal Revenue Code. This grant is not includible in your gross income.”

As some institutions of higher education (IHEs) open in the United States, CDC offers considerations for ways in which IHEs can help protect students, faculty, and staff and slow the spread of the coronavirus disease 2019 (COVID-19). These interim considerations are based on what is currently known about SARS-CoV-2 and COVID-19 as of the date of posting, June 30, 2020.

Considerations for Institutes of Higher Education
Last updated on May 30, 2020, the Centers for Disease Control and Prevention offers the several considerations for ways in which institutions of higher education can help protect students and employees (e.g., faculty, staff, and administrators) and slow the spread of COVID-19.

Interim Guidance for Administrators of US Institutions of Higher Education
Last updated on March 18, 2020, this interim guidance is intended to help administrators of public and private institutions of higher education prevent the spread of COVID-19 among students, staff, and faculty. The guidance includes considerations to help administrators plan for the continuity of teaching, learning, and research if there is community spread of COVID-19 and address concerns related to COVID-19 associated stigma.

U.S. Immigration and Customs Enforcement, Student and Exchange Visitor Program

Published on July 6, 2020, this Broadcast Message explains that SEVP is modifying temporary procedural adaptations related to online courses permitted during the height of the Coronavirus Disease (COVID-19) crisis for the fall 2020 semester. The U.S. Department of Homeland Security plans to publish the procedures and responsibilities described in the Broadcast Message in the near future as a Temporary Final Rule in the Federal Register. This message is intended to provide additional time to facilitate the implementation of these procedures

Published on March 13, 2020, this follow-up guidance addresses three common scenarios related to emergency procedures implemented by SEVP-certified schools: (1) a school completely closes and does not have online courses or other alternate learning procedures; (2) a school temporarily stops in-person classes but implements online or other alternate learning procedures and the nonimmigrant student remains in the United States; and (3) a school temporarily stops in-person classes but implements online or other alternate learning procedures and the nonimmigrant student departs the United States.

Veterans
Second GI Bill Fix for Student Veterans Impacted by COVID-19
On April 28, 2020, the President Trump signed into law H.R. 6322, the Student Veteran Coronavirus Response Act of 2020. This new law will give the Department of Veterans Affairs additional authorities to continue GI Bill and VR&E payments for the period beginning on March 1, 2020 and ending on December 21, 2020. VA has indicated it will provide new guidance and schedule training sessions with all VA approved schools and training facilities soon.

Veterans’ GI Bill benefits to continue during COVID-19 pandemic

On March 21, 2020, President Trump signed into law S. 3503, which authorizes the Secretary of Veterans Affairs to treat certain programs of education converted to distance learning by reason of emergencies and health-related situations in the same manner as programs of education pursued at educational institutions, and for other purposes.

According to the U.S. Department of Veterans Affairs, the new law gives VA authority to continue GI Bill payments uninterrupted in the event of national emergencies, such as COVID-19. The new law allows VA to continue to pay benefits regardless of the fact that the program has changed from resident training to online training. Students will also continue to receive the same monthly housing allowance payments that they received for resident training until December 21, 2020, or until the school resumes in-person classes.

VA indicates it is working to “immediately implement the new changes” to address current and future school terms to ensure students continue to receive their education benefits.

Published on April 2, 2020, VA’s Education Service posted these FAQs covering how the recently enacted S. 3503 impacts institutions of higher learning, non-college degree education or training institutions,  and on-the-job training and apprenticeship establishments.  

COVID-19 Informational Webinar
On March 26, 2020 and March 27, 2020, VA’s Education Service hosted a webinar for State Approving Agencies (SAAs) and School Certifying Officials (SCOs) to discuss COVID-19 and the impact to students attending school. According to an April 3, 2020 press release, the VA Debt Management Center is suspending all actions on Veteran debts under the jurisdiction of the Treasury Department until further notice.

In the midst of the Coronavirus pandemic, the proprietary school sector has a unique opportunity. The federal government has included our schools in the Emergency Stabilization Fund for institutions of higher education authorized by the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”). Starting the week of April 13, 2020, institutions are provided the opportunity to direct critical Higher Education Emergency Relief Fund (“HEERF”) grants to those eligible students most impacted by the pandemic. This guide, developed with the assistance of sector leaders, supports institutions in understanding what they should know regarding the student and institutional portions of the HEERF, provides example formulas for the distribution of emergency financial aid grants to students, includes a sample grant application form, and lists general principles institutions should consider. This guide will be updated regularly based on ongoing stakeholder feedback and federal updates, so institutions are encouraged to check back often. Congress
Congressional update as of April 10, 2020
  • Senate Democrats revealed their plan for an interim coronavirus aid package. It added conditions to Republicans’ request for $250 billion to replenish the SBA’s PPP program. However, the Senate adjourned today with no deal on interim funding for coronavirus relief. Sens. Mitch McConnell (R-KY) and Chris Van Hollen (D-MD) attempted to pass their respective party’s measures by unanimous consent but was blocked by the other.
  • Sens. Elizabeth Warren (D-MA) and Dick Durbin (D-IL) urged Education Secretary Betsy DeVos to exclude proprietary institutions from education funding in the CARES Act.
  • Reps. Josh Harder (D-CA) and Brian Fitzpatrick (R-PA) and others will introduce the COVID-19 Graduate Relief Act to defer student loans for three years for college graduates in 2020. Sen. Mitt Romney (R-UT) introduced similar legislation.
  • Sen. Kamala Harris (D-CA) and Reps. Alexandria Ocasio-Cortez (D-NY), Rashida Tlaib (D-MI), Ayanna Pressley (D-MA), and Ilhan Omar (D-MN) led a group urging congressional leaders to include monthly direct payments in a fourth coronavirus response bill.

Mnuchin Says He Thinks U.S. Businesses Could Reopen in May
Treasury Secretary Steven Mnuchin said Thursday he thought the United States could reopen the economy during May. “I think as soon as the president feels comfortable with the medical issues, we are making everything necessary that American companies and American workers can be open for business and that they have the liquidity to operate their business in the interim,” Mnuchin said. White House guidelines encouraging Americans to stay home and physically distance themselves are in place until April 30, meaning President Trump will face a decision soon on whether to relax or extend them. Fed Expands Corporate-Debt Backstops, Unveils New Programs to Aid States, Cities, and Small Businesses
The Federal Reserve unveiled an array of programs Thursday to provide $2.3 trillion in loans, expanding the Fed’s operations to reach small and midsize businesses and U.S. cities and states. The Fed said it would expand previously announced corporate lending programs to include some classes of riskier debt that had been excluded, including allowing firms that until recently had been rated as investment-grade to participate in those facilities. The Fed said it would enable new classes of debt in the previously announced Term Asset-Backed Securities Lending Facility, including triple-A rated tranches of existing commercial mortgage-backed securities and newly issued collateralized loan obligations. (WSJ 4/9)

  • The American College Health Association published a series of resources and guidelines to help college health staff and campus administrators prepare for COVID-19 and related issues on their campuses. These guidelines are intentionally broad so that each institution, small or large, can modify them based on existing campus and local resources.
  • Compiled by Daniel Stanford of DePaul University, this list provides various resources for institutions that may need to use distance education temporarily to accommodate students as a result of a COVID-19 interruption.  
  • Teach for Learners provides a searchable database for tools to support those involved in education and the workforce, at all levels, and from all communities as they scale up capabilities for online learning and continue teaching, learning, and working from home.
  • The Online Learning Consortium, Quality Matters, University Professional and Continuing Education Association, and the WICHE Cooperative for Educational Technologies has released joint responses on the ongoing COVID-19 situation. This statement includes several resources from these organizations.
  • The Online Learning Consortium published a list of tools and resources to support institutions’ efforts in moving courses to an online format when emergency situations arise. 
  • The Instructional Design Emergency Response (ID-ER) Network connects institutions and educators to online learning professionals willing to help convert face-to-face courses or course components to online offerings during times of crisis, such as natural disasters and epidemics.
  • Harvard University provides tips to support virtual science lab exercises. 
  • The Johns Hopkins Center for Health Security, the Council for Higher Education Accreditation, and Tuscany Strategy Consulting have collaborated to create a free resource to guide colleges on how to open campuses safely in the future. 
  • The National Association of Student Financial Aid Administrators created a web center to keep financial aid administrators updated on news related to COVID-19. 
  • Cooley LLP published two blog posts addressing moving offerings online and Title IV processing flexibilities associated with the response to COVID-19.
  • Duane Morris LLP issued an alert clarifying how higher education institutions can continue to comply with Title IV regulations for students whose activities are impacted by COVID-19.
